Our dedicated EPL team reduces your total cost of risk with claims services that include, but are not limited to, the following:

• A virtual claim file within our claims management system and online access to review and download reports of all matters.
  
  
• A dedicated claim team consisting of an account supervisor and claims resolution manager with experience in managing EPL matters in all U.S. jurisdictions.^*
  
  
• Loss runs that provide claimant demographic and financial information on all matters. If desired, we will populate our claims system with your historical EPL claims information, thereby providing one source for all EPL claims data.
  
  
• An evaluation of each claim for coverage under the applicable EPL policy and recommendations regarding coverage defenses and denials relative to the same.
  
  
• Subject to appropriate instructions from you in order to ensure all necessary functions of claims handling are performed, and, subject to your authority, we will retain, coordinate, and supervise the activities of defense counsel and take such other actions as may be necessary to accomplish the optimal disposition of all matters.
  

• Litigation management services, including review of all bills and statements from defense counsel, experts, and other vendors, to ensure the work performed on your insured’s behalf is properly invoiced and substantiated.
  
  
• If requested, we will pay claim expenses and settlements from a designated trust account and issue annual 1099 statements to all vendors that have received a payment from us on your behalf.
  
  
• Reporting on all applicable state and federal matters, including MMSEA Section 111.
  
  
• Regularly scheduled claim meetings to discuss the most significant matters, as well as any trends and/or concerns impacting the future profitability of the program.

Arbitration

Claim overview:

An arbitration demand alleging gender discrimination, harassment; retaliation, failure to prevent harassment and/or retaliation and wrongful termination in violation of public policy filed by a former employee physician against the client hospital and fellow MD. Our EPL team assisted with early settlement efforts that successfully resulted in the settlement of this matter far below the lowest range recommended by defense counsel.

Claim overview:

A pre-litigation demand letter coupled with a Charge of Discrimination filed with the Department of Fair Employment and Housing (DFEH) alleged disability and age discrimination, harassment and retaliation. GB Specialty’s EPL team was instrumental in orchestrating an early settlement with low defense costs through early evaluation of risk and identification of settlement opportunities.

Claim overview:

A Wage and Hour class action lawsuit with exposure in excess of $125 million had been in litigation for three years prior to the implementation of our EPL program.
